What Happens if I'm Convicted?

In California, crimes are divided into two categories: misdemeanors and felonies. The consequences you would face after a conviction depend on what kind of crime was involved. It also important to note that many crimes are deportable offenses, which means that you may deported if you are convicted. Misdemeanors

A misdemeanor is a less serious crime, but can still bear significant penalties and consequences. If you are convicted of a standard misdemeanor, you will face up to 6 months in jail and/or a fine of up to $1,000. A "gross" or "aggravated" misdemeanor is punishable by up to 364 days in jail and/or a fine of $1,000 or more. Examples of standard misdemeanors include possession of illegal drugs, petty theft and shoplifting, prostitution, and being drunk in public. "Aggravated" misdemeanors include domestic battery, driving while under the influence (DUI), driving while your license is suspended, and more. Some sex crimes, such as rape and statutory rape, may also be tried as misdemeanors.

A misdemeanor conviction may also result in a probationary period of 1-3 years, during which time you must abide by certain rules and restrictions to avoid going to jail. Probation may include community service, house arrest, monitoring, and more. Additionally, a misdemeanor will go on your criminal record and may make it difficult to find employment and housing in the future. Felonies

Felony crimes are much more serious and can result in severe penalties. Some felony charges can be reduced to misdemeanors through defense representation, and are called "wobblers." Wobbler crimes include domestic violence, assault with a deadly weapon, forgery, sexual battery, statutory rape, grand theft, and more. Other felonies, however, cannot be reduced and are known as "straight felonies." These include murder, rape, selling illegal drugs, vehicular manslaughter with gross negligence, and lewd acts with a child under 14 years old. Prison sentencing for murder is a minimum of one year and can range dramatically depending on the severity of the case. In the most severe circumstances, an individual might face life in prison.
